HEARING CHALLENGE COACH, LLC, provides communication-training services designed to support individuals with hearing challenges in turning obstacles into opportunities for better communication and understanding.

 

1. Agreement to Terms

  •  These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”) and HEARING CHALLENGE COACH, LLC (“Hearing Challenge Coach,” “Company,” “HCC,” “we,” “our,” or “us”).
  • By accessing or using this website and any enrolling in any class, course, coaching session, or service offered by HCC, participants acknowledge and agree to be bound by these Terms.
  • These Terms apply to all offerings, whether delivered online, on-demand, or live.

2. Hearing Challenge Coach (“HCC”) Terminology

  • Front Row: HCC uses the phrase “Front Row” as a descriptive reference to the ideal learning position — being fully engaged, supported, and able to participate with clarity. This usage is unique to HCC’s communication-training context and is not associated with other programs or services that may use similar wording.
  • Achievers / Participants / Students: Since 98% of our participants learn more than expected, HCC uses the encouraging term “achievers” to describe those who engage in our programs. This term is descriptive and motivational, and is used interchangeably with “participants” and “students” throughout our materials.
  • Coach / Instructor / Speaker / Teacher: HCC uses the terms “coach,”  “instructor,” “speaker,” and/or “teacher” to refer specifically to the individual(s) presenting our live and/or on-demand video classes. These are used interchangeably to denote the role of a speaker or presenter. Use of these terms is solely for ease of reference and shall not be construed to imply that the individual(s) holds any specific professional certification, license, accreditation, or degree unless explicitly stated otherwise.

3. Modification of Services

  • HCC reserves the right to modify, suspend, or discontinue any class, course, coaching session, program, or service at its sole discretion.
  • When feasible, advance notice of changes will be provided.

4. Scope of Services

  • HCC provides:
    • One-on-one coaching sessions and other professional services.
    • Free and/or paid video classes and courses are accessible via our website and/or through third-party video-hosting and/or social media platforms.
    • Live classes, courses, and other services as described on our website.
  • HCC reserves the right to modify, suspend, or discontinue any class, course, coaching session, program, or service at its sole discretion. When feasible, advance notice of changes will be provided.

5. User Eligibility and Obligations

  • HCC services are intended for adults. Participants must be at least 18 years old or the age of majority in their jurisdiction.
  • Users are responsible for maintaining the confidentiality of account credentials.
  • Users agree to provide accurate and complete information when registering or purchasing services.

6. Orders and Payments

  • All payments are processed through secure third-party providers.
  • All fees are due at the time of purchase unless otherwise stated.
  • Free classes still require registration. Just add the class to your cart, complete the $0.00 checkout, and your access link will be emailed to you.
  • HCC reserves the right to refuse or cancel any enrollment or payment at its sole discretion, including but not limited to cases of inaccurate information, suspected fraud, or administrative error.

7. Access to Content

  •  Free and/or paid classes or courses are available via HCC’s website, Vimeo, YouTube, Zoom, and/or other designated platforms, subject to their terms of service. You do not need an account with them in order to participate.
  • HCC is not responsible for outages, restrictions, or technical issues arising from third-party platforms. If a session cannot continue due to such issues, HCC will contact the participant by text or email as soon as possible to arrange a rescheduled time.
  • Participants are responsible for ensuring accurate contact information so access links can be delivered.

8.  Types of Classes and Services HCC Offers

 

8A. On-Demand Video Classes

  • Checkout process: Add to Cart → Enroll & Complete Cart Process  → Access Link Sent via email
  • On-demand video classes are available immediately after purchase.
  • No scheduling is required.
  • Access instructions appear automatically at checkout and/or are sent by email after payment.
  • For our free (promotional) on-demand video classes, the checkout process is the same. However, the price is $0.

8B. Live Classes

  • Checkout process: Contact Coach → Review Schedule Options → Add to Cart → Enroll & Complete Checkout Process → Receive Access Link via email (or other agreed upon method)
  • Participants contact HCC to discuss available dates and times.
  • A mutually agreeable schedule is confirmed before any payment is made.
  • Once the schedule is set, the participant completes enrollment and payment through the website.
  • After payment is received, HCC emails the access link and/or session details.
  • Achievers are welcome to reach out with availability questions at any time.

8C. Coaching Sessions, Consulting, Lip Reading Interpretation, and Other Services

  • Those interested in Coaching Sessions, Consulting requests or Lip Reading Interpretation services or other services may contact HCC through the contact page for questions and quotes; these are scheduled in advance and subject to availability.
  • Cancellation and rescheduling policies will be communicated in our response.

9. Enrollment and Payment

  • Enrollment for all offerings is completed through the HCC website.
  • Payment is required to secure access to on-demand classes or to finalize scheduled live sessions.
  • Accepted payment methods are listed during checkout.
  • Participants are responsible for ensuring accurate contact information so access links can be delivered.

10. Refunds and Cancellations

 

10A. PAID Courses and Digital Content

  • All sales of digital courses and video content are considered final once access has been granted.
  • Refunds will not be issued for completed or partially completed classes or courses.
  • In cases of technical issues preventing access, HCC will work with the User to restore access or, if restoration is not possible, issue a refund at HCC’s discretion.

10B. Coaching and Professional Services

  • Coaching sessions may be cancelled or rescheduled by the User with at least 48 hours’ notice prior to the scheduled time.
  • Cancellations made with less than 48 hours’ notice may be charged in full and are not eligible for refund.
  • HCC reserves the right to cancel or reschedule sessions due to unforeseen circumstances. In such cases, Users will be offered a full refund or the option to reschedule.

10C. Refund Processing

  • Approved refunds will be processed within 7–10 business days to the original payment method.
  • HCC is not responsible for delays caused by third party payment processors or financial institutions.
  • Any approved refund will be issued to the original payment method.

10D. Non-Refundable Items

  • Promotional offers, discounted packages, and bundled services may be designated as non-refundable at the time of purchase.
  • Any services explicitly marked “non-refundable” are excluded from this refund policy.

11. Intellectual Property Rights

  • All content, including but not limited to videos, text, graphics, logos, and trademarks, is the exclusive property of HCC unless otherwise noted.
  • Users are granted a limited, non-transferable license to access content for personal, non-commercial use only.
  • Unauthorized reproduction, distribution, or exploitation of HCC’s content is strictly prohibited.

12. Educational References and Third-Party Mentions

  • Educational materials used in HCC classes may reference brand names, products, or publicly available resources. These references are provided for informational and educational purposes only and do not imply endorsement, affiliation, or accuracy. Participants are encouraged to use this information for learning and personal exploration only, not for commercial use.

13. Technology Requirements

  • Participants are responsible for ensuring they have:
    • A stable internet connection
    • A device capable of accessing video content
    • Audio equipment suitable for their hearing needs
  • HCC is not responsible for technical issues on the participant’s device or network.

14. Communication and Support

  • HCC communicates primarily through email for scheduling, access links, and
    support.
  • Participants are encouraged to check their email regularly and add HCC to their safe-sender list.
  • Questions or concerns may be directed to the contact information provided on the website.

15. Personal Responsibility and Participation

  • Participants engage in classes and coaching at their own pace and comfort level.
  • HCC provides guidance, strategies, and tools, but individual results may vary.
  • Achievers are encouraged to practice skills consistently to maximize progress.

16. Prohibited Conduct

  • Users shall not:
    • Engage in fraudulent, abusive, or unlawful activity or language.
    • Attempt to copy, resell, or redistribute HCC’s content without authorization.
    • Interfere with or disrupt the operation of the website or services.

17. Limitation of Liability

  • HCC provides all services “as is” and disclaims all warranties, express or implied.
  • HCC shall not be liable for indirect, incidental, or consequential damages,
    including but not limited to loss of data, profits, or business opportunities.
  • HCC’s total liability shall not exceed the amount paid by the User for the specific service giving rise to the claim.

18. Privacy

  • Use of HCC’s services is subject to our Privacy Policy, which governs the collection and use of personal data. Refer to the website, www.hearingchallengecoach.com for the Privacy Policy.

19. Amendments

  • HCC reserves the right to amend these Terms at any time. Updates will be posted on
    this page, and continued use of services constitutes acceptance of the revised Terms.

20. Governing Law and Jurisdiction

  • These Terms shall be governed by and construed in accordance with the laws of Columbia County, Florida (Third Judicial Circuit of Florida). Any disputes shall be subject to the exclusive jurisdiction of the courts located in the Third Judicial Circuit of Florida.

21. Agreement

  • By enrolling in any class, course, coaching session, or service, participants
    acknowledge that they have read, understood, and agree to these Terms, Conditions, and Policies.
  • HCC reserves the right to terminate services for violations of these Terms.
